Myrtle Beach Helmet Law Struck Down

In a unanimous decision announced in June, the South Carolina Supreme Court ruled that a Myrtle Beach law requiring motorcyclists to wear helmets is invalid. The ruling also negated several other ordinances the Myrtle Beach City Council had enacted in 2008 to rid the city of biker events.

The court ruled that the city could not supersede state law, which does not require helmets for any motorcycle riders over 21. The court said that if cities were allowed to enact such laws, it would be too confusing for motorcyclists traveling across the state.

Just after the South Carolina Supreme Court struck down Myrtle Beach’s helmet law, a Virginia-based lawyer filed a lawsuit on behalf of several bikers and motorcycle groups in Myrtle Beach, claiming city ordinances passed nearly two years, particularly a noise ordinance, ago don’t follow state law.

Myrtle Beach City Council passed stricter noises ordinances two years ago in an unabashed and admitted attempt to chase and keep motorcyclists out of the Atlantic Coast resort city.

By Alicia McNally

Never have so many motorcycle enthusiasts geared up to put on the brakes.

But when SB-040 coasted through a senate committee nearly undetected, letters and phone calls from motorcycle enthusiasts around the state poured in to put it to a halt.
